Terms of Service

In accordance with the terms and conditions of the Terms of Service (including all policies related to them), VIXNODE Official (hereinafter referred to as " VIXNODE or its subcontractors will provide web-based VIXNODE services that allow you to store, retrieve, organize and share data ("Services"). You may not attempt to access VIXNODE any other systems, programs or data that are not publicly available.

You acknowledge and agree that the form and nature of the services provided by VIXNODE may change or be revised without notice. VIXNODE may at any time limit the maximum storage space you have on VIXNODE without notice and limit the amount of bandwidth available to you for the Services for a given period of time in response to unreasonable activity.

You agree that VIXNODE shall not be liable or liable for the deletion, damage, alteration or failure to store any messages and other communications, data, text, software, music, audio files, photos, graphics and videos provided. it's up to you (collectively, "content") and maintained or transmitted by the service. You acknowledge that VIXNODE reserves the right to change these general practices and restrictions at any time at its sole discretion without notice.

Given your use of the Services, you should provide information about yourself (e.g. e-mail or contact details) during the service registration process. You agree that any registration information you provide to VIXNODE will always be true, accurate, complete and up-to-date.

You agree to use the Services only in accordance with the Terms and any applicable laws, government regulations, or generally accepted practices or guidelines in the relevant jurisdiction.

By submitting anything to VIXNODE, you warrant that you are the owner of the content or that you have been granted all necessary rights by the owner of the content to submit the content to VIXNODE.

You agree not to copy, copy, sell, resell, rent, lease, re-license or redistribute the Services for any purpose.

You agree not to access the Services in any way other than the interface provided by VIXNODE for access to the Services.

You acknowledge and agree that the Service contains proprietary and confidential information protected by applicable intellectual property and other laws, and you agree not to disclose such information to any third party without the prior written consent of VIXNODE, unless otherwise required by law or court order.

VIXNODE acknowledges that you have all legal rights, title and interests in all content, including copyright, trademarks and other intellectual property rights contained in that content. You grant VIXNODE the right to use such content only to the extent that VIXNODE needs to use the content to provide the services.

All information maintained by the Service ("Confidential Information") shall be kept confidential by the parties accessing and using the Service and VIXNODE (collectively, "Parties"). Each party shall take reasonable steps to prevent the unauthorized disclosure or use of confidential information for any purpose other than those within the scope of these Terms, but in no event shall it take fewer steps than those taken to protect its own confidential information. Each party may not disclose confidential information to any person or entity that requires access to such confidential information, except its subordinate entities, officers, employees, consultants, auditors and lawyers, and that individual or entity shall be held confidential with that party or VIXNODE.

VIXNODE reserves the right to modify or update the Services (or any part of them) at any time without notice. These updates are designed to improve, enhance, and further develop services. You agree to receive such updates when you use the Services (and allow VIXNODE to provide you with those updates). You agree that VIXNODE shall not be liable for any modification, suspension or termination of the Service by you or any third party, or for any loss or damage caused by any content you place on the Service.

VIXNODE may change the terms of service from time to time. After these changes are made, VIXNODE will provide a new copy of the Terms of Service on the Services website. By continuing to use any Services after your modification, you accept the newly modified Terms of Service.

You agree to pay all fees for the service plan specified in all of the purchase orders below or described on the account page.

Users can choose to pay monthly or annually. Charges are based on the services purchased and not on actual usage. VIXNODE reserves the right to suspend user accounts that are not paid according to the payment schedule. All fees are non-refundable.

User subscription fees are based on monthly charges from the subscription start date and the start of each month's anniversary;

The Terms of Service shall take effect from the date of registration and shall continue on a monthly (monthly) or annual basis (if applicable) until all user subscriptions granted under this Agreement have expired or been terminated, or until such time as required.

You acknowledge and agree that VIXNODE may terminate its legal agreement with you at any time if (a) you have violated the letter or spirit of the Terms of Service or the Terms of Service, (b) you have committed any of the following acts: infringing the rights of VIXNODE or third parties, or (c) requiring VIXNODE to do so (for example, it is illegal to provide services to you or become illegal).

You clearly understand and agree that:

1. (a) You do so at your own risk. The service is provided on an "as is" and "available" basis. VIXNODE and its suppliers expressly deny warranties of any form, express or implied, including, but not limited to, implied warranties of marketability, suitability for specific uses and non-infringement.

2. (b) VIXNODE and its suppliers do not provide any warranty (1) that the Services will meet your requirements or result in revenue or profits, (2) that the Services will be undisturbed, timely, safe or error-free, (3) that the results may be accurate or reliable as a result of the use of the Services, and (4) that any operational or functional defects provided to you with the Services will be corrected.

3. (c) Any material downloaded or otherwise obtained as a result of the use of the Service is at your sole discretion and at your own risk, and you are solely responsible for any damage to computer systems or other equipment or the resulting loss of data.

4. (d) Any advice or information you receive from VIXNODE or through the Service, whether oral or written, does not constitute any warranty not expressly stated in the Terms of Service.

You represent that, to your knowledge and belief, your use of the Service does not directly or indirectly infringe the legal rights of third parties. You further represent and warrant that all information you provide about registration is accurate and reliable.

In some cases, certain jurisdictions do not allow the exclusion of certain security or limitations or limitations on liability for incidental or secondary damages. Therefore, restrictions that are legal only in your jurisdiction apply to you, and our liability will be limited to the maximum extent permitted by law.

VIXNODE will defend and compensate entities or individuals who accept the terms of service accepted by third parties in order to prevent third-party litigation against that entity or individual, provided that the act infringes any copyright, trademark or trade secret based on the services provided to you by VIXNODE and is used within the terms of service, and will pay any costs, damages and reasonable attorney's fees against such claims as determined by the final judgment or settlement against such entity or individual.

You agree to indemnify and hold harmless VIXNODE, its subsidiaries and affiliates, and their directors, officers, agents, and employees (hereinafter referred to as "Indemnifying Parties") from any claim or demand made by any third party, including reasonable attorneys' fees, arising out of or related to content you provide, your use of the Services, your connection to the Services, your violation of the Terms of Service, or your infringement of any proprietary or other rights of another person. You further agree and acknowledge that the Indemnifying Parties shall not be liable for any error, omission, or any other act arising out of or in connection with the use of the Service. You further agree to indemnify, defend, and hold harmless the Indemnifying Parties from any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees and costs) arising out of or relating to your use of the Service, any messages, information, software, or other materials placed or transmitted by you or your account user through the Services, or any breach of the Terms of Service by you or your account user.

You expressly understand and agree that VIXNODE and its suppliers are not responsible for any direct, indirect, incidental, incidental, special, consequential or proprietary damages, including but not limited to loss, benefit, loss of use or use (even if you have been advised that such damage may occur in VIXNODE), which may also result from (1) the use or inability to use the Service, and (2) any goods entered or received through or from the Services, data, the cost of purchasing alternative goods and services purchased or acquired by information or services, (3) unauthorized access to or alteration of your transmission or data, (4) statements or actions of any third party to the Services, or (5) any other matters relating to the Services.

You agree that VIXNODE shall not be liable for any (a) business interruption, (b) delay or interruption of access to this website through this Service, (c) failure to deliver, incorrect delivery, damage, damage or other modification of data, (d) unauthorized access to the Data entered in the Services or any of its restricted fields or any breach of any security mechanism used, or (e) events beyond the reasonable control of VIXNODE.

In no event shall the maximum cumulative liability of VIXNODE exceed the maximum fee you pay for the services of VIXNODE.

The Services may provide notice of changes to the Terms of Service or other matters by generally showing you a notification or a link to the notice on the Service.

The Terms of Service (and the policies associated with them) constitute the full agreement between you and VIXNODE and govern your use of the Services and supersede any previous agreement between you and VIXNODE (including, but not limited to, any previous version of the Agreement).

The Terms of Service will ensure the interests of VIXNODE and their heirs and assignees.

The Terms of Service do not limit any rights of VIXNODE under trade secrets, copyrights, patents, trademarks, or other laws. VIXNODE's failure to exercise or enforce any right or provision of the Terms of Service does not constitute a waiver of that right or provision. If a court of competent jurisdiction finds that any provision of the Terms of Service is invalid, the parties agree that the court shall endeavor to fulfill the intention of the parties as reflected in the Terms, and the other provisions of the Terms of Service will remain in full force and effect.
